If you’re heading to Glacier, hiking near Flathead Lake, or spending time in the valley, it’s worth knowing where cannabis is actually legal to use. (General information, not legal advice.)

Public consumption in Montana

Montana law doesn’t allow consuming marijuana in a public place, and the Department of Revenue has not approved any public consumption areas. That covers places like parks, sidewalks, streets, trailheads, and parking lots. Smoking in public carries a civil fine of up to $50, and other penalties can apply. Consumption is generally limited to private property with the owner’s permission.

National parks and federal land

Glacier, Yellowstone, and all national forests (including the Flathead National Forest) are federal land, where cannabis remains illegal under federal law regardless of Montana’s rules. Possession or use there can bring federal charges. The same goes for BLM land and other federally managed areas, and many popular trails and recreation spots around the valley are federally managed.

State parks and other public land

State parks and most public recreation areas are still public places under Montana law. Consumption isn’t allowed.

Where it is allowed

Legal use is generally limited to private residences or private property where the owner allows it. Smoking is also barred in hotel or motel rooms unless the room is a designated smoking room. Some short-term rentals allow it, many don’t, so check in advance. If you’re visiting, the safe move is to keep consumption on private property and leave cannabis out of parks and public lands entirely.
